This Policy is projected to all personal information and sensitive personal data or information that is given by or obtained from any person who visits or uses or accesses the website ("User"). We reserve the right to modify or review the details of this Policy without prior notice and the revised Policy will be in effect from the day of uploading. Therefore, Users are requested to periodically visit the website and review the policy.

Definitions

In this Agreement, the following capitalised words have these specific meanings.

 

'Product' means an item available for sale on our website.

'Website' means Lyon Cherie Website or App.

General

In consideration of Lyon Cherie agreeing to supply goods to the Customer, the Customer agrees and accepts that these terms and conditions apply to all sale of goods by the supplier to the Customer, to the exclusion of any conditions of sale appearing on any document of the Customer. The Customer further acknowledges that these Terms and Conditions of Sale constitute the entire agreement of the parties as to the supply of goods by the supplier, and may not be varied without the prior written agreement of the supplier.

Agreement

We try to ensure that product details displayed on the Website are correct and up-to-date. However, any error or omission in any information on the Website, or in any other communication or document issued by us, may be corrected without any liability on our part. You will then be given the option of re-confirming your order at the correct price or cancelling your order. If you have already paid for the Product(s) at the erroneous price, you will receive a full refund if you decide to cancel.

Images of products on the Website are intended as a guide and the actual product may differ slightly in some respects. All weights and dimensions given are approximate.

Before clicking the ‘Confirm Order’ button, you should check that your order summary is correct. You should print or retain your email confirmation in case you need to contact us about your order.

Ordering

Orders of Product(s) are subject to availability. When you place an order, we will confirm it by email, but the order will only become legally binding on us when we send you an email confirming dispatch of the Product (s). If we cannot fulfil your order for any reason, we will notify you as soon as we reasonably can.

Payment

Unless otherwise stated, all prices shown on the website are inclusive of VAT, sales tax and GST. Duties, customs charges or any other applicable taxes which vary from country to country are at the customers expense. The prices shown do not include the delivery fee, which will be added to your total order price.

Orders must be paid for immediately by credit or debit card. If we cannot accept your order for any reason, we will process a full refund within 14 days.

Delivery – Returns – Claims

We will endeavour to deliver the Product(s) as soon as possible after confirmation of your order. However, we cannot accept responsibility for loss or damage caused by any delay in delivering the Product(s). We will try to keep you informed in the event of any delay.

Delivery will be to the address specified by you when ordering. We do not know and cannot control what additional charges, custom fees or taxes you may have to pay once the Product(s) reach the destination country.

If you have a problem with your order please contact info@lyoncherie.com prior to returning, we will try our best to get back to you within 5 working days but may take longer at peak times. If we have been unable to delivery your parcel and it is returned to our warehouse we will contact you. 

We must be notified in writing within 7 days of receipt of goods about all lost or damaged goods. Any notification later than this will result in a void claim.

As soon as the Product(s) are delivered to you, you become the owner of those Product(s) and the risk will passed to you. This means that you will be liable for any subsequent damage, loss or destruction to the Product(s). 

Customers are responsible for all return of product postage costs. Items must be in original condition and returned with the original sales receipt. 

Claims arising from damage or loss in transit must be made in writing within 7 days of delivery deadline date. Items must be returned within fourteen (14) days of delivery for credit or refund. A request for return must be made in writing and returns will not be accepted without prior approval from the supplier. Lyon Cherie reserves the right to charge an administration/handling fee. All freight costs in relation to returns are at the Customers expense.

Most shoe product are dispatched separately from other products in your order.

Please note that we are unable to influence the delivery of any parcels once they have left the warehouse. Please ensure you have entered the correct delivery details prior to confirming your order. If we are unable to deliver due to wrong information being input at the order stage you will still be charged for all original and additional redelivery costs.

Should you feel that your order has become lost or was unable to be delivered to you please contact us. Please note that we will try our best to resolve this issue but we may feel it is appropriate to refund or credit your order after a second delivery attempt.

 

We use a broad range of couriers for our parcel deliveries to reduce costs to our customers. We use express courier to track and provide the quickest delivery for our astute customers.

Delivery times can vary and depend on delivery method chosen.

Standard: 10-31 days

Express Courier Service: 3-10 days

Most Items delivered are tracked for quality and reassurance. These are a guide and can change and be delayed without notice In some instances once the parcel has been delivered unfortunately we are unable to influence the delivery. Please try contacting your local postal agent/office; they may be able to help..

Warranty Disclaimer and Limitation of Liability

Products are sold as is. The Customer acknowledges that no warranty; condition, description or representation in relation to goods supplied is given by the supplier, expressly or implied. All warranties, terms and conditions in relation to the state, quality of the goods and of every other kind whether implied by use, statute or otherwise are hereby excluded.

Lyon Cherie shall not be liable for physical or financial injury, loss or damage or for consequential loss or damage of any kind arising out of the supply of the goods arising out of the supplier’s negligence or in any way whatsoever. Lyon Cherie will not be held legally liable for manufacturing defects or issues, or customer expectations that go unmet.

Lyon Cherie is not held legally liable for any injuries or damage that result from the faulty good that you sold. The manufacturer will be held solely liable.

Customs and Duty

Please note that all shipments to countries may be subject to import duties and taxes, which are levied once a shipment reaches your country. Customs policies vary widely from country to country; you may want to contact your local customs office for further information. Import duties and taxes are the responsibility of the customer. If the customer rejects a delivery of stock, they will be responsible for all charges incurred for customs clearance, delivery, returns and warehousing. Also any damages or breakages incurred while the goods are being returned are also the responsibility of the customer.

Governing Law

These Terms and Conditions of Sale shall be construed in accordance with the law in force in New South Wales, Australia and the parties agree to submit to the non-exclusive jurisdiction of the Courts of that state.

Severability

Where these Terms and Conditions of Sale are qualified by any provision of law which applies and which cannot be excluded, where any such provision in these Terms and Conditions of Sale is deemed to be unlawful or unenforceable, such provision shall be severed from these Terms and Conditions of Sale and all other provisions hereof shall remain in force to the fullest extent permitted by law.
